Today, public health regulation at all levels faces unprecedented challenges both at home and abroad. The September 11, 2001 attacks on New York and Washington, D.C., by the Al Qaeda terrorist network and the anthrax bioterrorism that followed shortly thereafter have put public health regulation at the forefront of homeland security. The anthrax scare, in particular, has greatly tested the American public health system, calling into question whether the United States and its component states and localities are prepared to handle (...) a major outbreak of infectious disease, such as smallpox, in a future bioterrorist action. While the response of public health agencies was commendable, especially in light of the magnitude of the assaults, it is manifestly clear that the American public health system will be hard pressed to meet similar challenges that may lie ahead.The events of fall 2001 follow a period of major challenges for public health. In contemporary philosophy, “fictional worlds” are one solution to the problem of how there can be true and false judgments about fictional characters. Fictional-world accounts generally disregard whether facts are explicitly stated in the story or not; it is enough for them to be logically implied. And yet, as Ruth Lorand has observed, whether a fact is stated or merely implied changes the meaning of a story. Having a serious illness like breast cancer is a calamity for individuals and families. Along with the pain, discomfort, and dislocation comes the issue of how to pay the medical expenses for the care and treatment of the disease. If the seriously ill person has inadequate or no insurance, these problems are aggravated.Stories abound about seriously ill people losing private health insurance following diagnosis with a catastrophic disease, remaining in jobs just to maintain health insurance, or facing financial hardship because (...) of gaps in coverage. Yet surprisingly little research has focused on the problems that people with serious illness face with health coverage and, in particular, how concerns about access to health insurance coverage shape their lives.Further, despite profoundly moving anecdotes of cancer victims and other seriously ill people about their problems with health insurance and despite recent federal and state efforts to reform the private health insurance market in ways discussed below, neither the federal government, states, nor the private sector has crafted comprehensive strategies to enhance health coverage for the seriously ill. There have always been medical standards of care in the American health-care sector. However, never before have they been so deeply incorporated in the delivery of health care as they are today. With the increased delivery of care through integrated delivery systems, as well as the development of the computerized patient record, medical standards of care are now used in innovative ways by providers and health plans in delivering health care to individual patients. There is great potential for even more (...) innovative uses of medical standards of care in the future.This article first presents a taxonomy of the medical standards of care that are involved in health-care delivery today Next, the article traces the historical evolution of medical standards of care since the early 1980s. Included in this discussion are the origins of the standard-setting movement as well as the developments that led to the way standards of care are currently used by large institutional providers and managed care plans to improve the quality of their health-care services. The Allies envisioned a coordinated world in which human rights for all were respected, economic and social progress for all promoted, and global warfare prevented. This was a phenomenally fantastic vision that seemed unattainable in the wake of the most devastating global war in history.Today, the world is witnessing some of the fruits of these mid-20th century events and aspirations, especially (...) since the collapse of Communism in 1989. Economic integration and free trade has become much more prevalent as exemplified by astounding developments such as the European Union. And there is a greater appreciation of human rights, including the international human right to health. This article examines the evolution of trade policy and the impact of free trade policies on the health care sectors of the three countries of North America and the realization of the human right to health in North America. With new, effective, and expensive health care services, the American health care sector has become an even greater source of business and wealth opportunities. All kinds of health care providers and suppliers are competing for patients and dollars. The key to wealth in today’s health care sector is the physician. Only physicians can certify to third-party payers that health care services, medical devices, or pharmaceutical products are necessary for patient care. That certification initiates the process by which the item, service, (...) or treatment modality is ordered, delivered, and paid for. Discussions of research involving vulnerable populations have left the homeless comparatively ignored. Participation by these subjects in drug studies has the potential to be upsetting, inconvenient, or unpleasant. Participation occasionally produces injury, health emergencies, and chronic health problems. Nonetheless, no ethical justification exists for the categorical exclusion of homeless persons from research. The appropriate framework for informed consent for these subjects of pharmaceutical research is not a single event of oral or written consent, but a multi-staged arrangement of disclosure, dialogue, (...) and permission-giving. Payments and other rewards in biomedical research raise issues of whether it is ethical to offer inducements to the homeless in exchange for participation in drug studies. Such inducements can influence desperate persons who are seriously lacking in resources. The key is to strike a balance between a rate of payment high enough that it does not exploit subjects by underpayment and low enough that it does not create an irresistible inducement. This proposal does not underestimate the risks of research, which are often overestimated and need to be appraised in light of the relevant empirical literature. (shrink)

Growth mindset is an important aspect of children’s socioemotional development and is subject to change due to environmental influence. Orchestral music education may function as a fertile context in which to promote growth mindset; however, this education is not widely available to children facing economic hardship. This study examined whether participation in a program of orchestral music education was associated with higher levels of overall growth mindset and greater change in levels of musical growth mindset among children placed at risk (...) by poverty. After at least 2 years of orchestral participation, students reported significantly higher levels of overall growth mindset than their peers; participating students also reported statistically significant increases in musical growth mindset regardless of the number of years that they were enrolled in orchestral music education. These findings have implications for future research into specific pedagogical practices that may promote growth mindset in the context of orchestral music education and more generally for future studies of the extra-musical benefits of high-quality music education. The novel strain of influenza A virus that emerged in the spring of 2009 and rapidly spread around the globe was no exception. The H1N1 pandemic prompted the first significant application of a number of international legal and policy mechanisms that have been developed in the last decade to respond to this kind of event. Furthermore, it presented a considerable test for public health systems at all levels, (...) from global to local.Although initial predictions forecasting high morbidity and mortality from this virus overestimated its eventual impact, the human toll of the pandemic was nevertheless significant. The World Health Organization reported approximately 1.5 million people were infected worldwide in 214 countries, resulting in over 25,000 confirmed deaths, but the actual health impact of the outbreak was certainly much higher. We review here the data indicating a role for epidermal growth factor receptor (EGF receptor) signalling in early mouse development. Embryonic development of the metazoan embryo generally begins with the formation of a cystic structure and epithelial layers that subsequently form anlagen of the definitive body parts and organs. For the mammalian embryo, this cystic structure is a blastocyst whose wall consists of trophectoderm, the first epithelium to develop during mammalian embryogenesis. The onset of expression and function of EGF receptors (...) is coincident with the onset of trophectoderm development. Modulating EGF receptor expression and function modulates trophectoderm differentiation, leading to the hypothesis that functional EGF receptors participate in the induction of trophectoderm development and perhaps of other embryonic epithelial derivatives such as nervous tissues. I look at the ‘flavour-oscillation clocks’ proposed by D. V. Ahluwalia and two of his arguments suggesting that such clocks might behave in a way that threatens the geometricity of general relativity (GR). The first argument states that the behaviour of these clocks in the vicinity of a rotating gravitational source implies a non-geometrical element of gravity. I argue that the phenomenon is best seen as an instance of violation of the ‘clock hypothesis’ and therefore does not threaten the geometrical (...) nature of gravitation. Ahluwalia’s second argument, for the ‘incompleteness’ of general relativity, involves the idea that flavour-oscillation clocks can detect constant gravitational potentials. I argue that the purported ‘incompleteness-establishing’ result is in fact one that applies to all clocks. It is entirely derivable from general relativity, does not result in the observability of the potential, and is not at odds with any of general relativity’s foundations. (shrink)

Ethics networks have emerged over the last few decades as a mechanism for individuals and institutions over various regions, cities and states to converge on healthcare-related ethical issues. However, little is known about the development and nature of such networks. In an effort to fill the gap in the knowledge about such networks, a survey was conducted that evaluated the organizational structure, missions and functions, as well as the outcomes/products of ethics networks across the country. Eighteen established bioethics networks were (...) identified via consensus of three search processes and were approached for participation. The participants completed a survey developed for the purposes of this study and distributed via SurveyMonkey. Responses were obtained from 10 of the 18 identified and approached networks regarding topic areas of: Network Composition and Catchment Areas; Network Funding and Expenses; Personnel; Services; and Missions and Accomplishments. Bioethics networks are designed primarily to bring ethics education and support to professionals and hospitals. They do so over specifically defined areas—states, regions, or communities—and each is concerned about how to stay financially healthy. At the same time, the networks work off different organizational models, either as stand-alone organizations or as entities within existing organizational structures. (shrink)

This article identifies a papyrus in Warsaw, P.Vars. 6, as a fragment of the large Latin–Greek glossary known as Ps.-Philoxenus. That glossary, published in volume II of G. Goetz's Corpus Glossariorum Latinorum on the basis of a ninth-century manuscript, is by far the most important of the bilingual glossaries surviving from antiquity, being derived from lost works of Roman scholarship and preserving valuable information about rare and archaic Latin words. It has long been considered a product of the sixth century (...) a.d., but the papyrus dates to c.200, and internal evidence indicates that the glossary itself must be substantially older than that copy. The Ps.-Philoxenus glossary is therefore not a creation of Late Antiquity but of the Early Empire or perhaps even the Republic. Large bilingual glossaries in alphabetical order must have existed far earlier than has hitherto been believed. (shrink)

Le présent article traite des origines de la théorie de la catégorisation, telle qu’elle fut élaborée par Eleanor Rosch dans les années 1970. Il est divisé en deux parties. La première est consacrée au contexte théorique dans lequel les recherches initiales de Rosch ont pris place. Pour bien comprendre ce contexte, il convient de remonter aux recherches de Lenneberg et de ses coauteurs sur le principe de relativité de Whorf. On retracera ainsi le cheminement qui mena de ce principe (...) jusqu’à sa reformulation comme hypothèse empiriquement testable, en partant des études sur la catégorisation des couleurs (menées à l’université de Harvard) pour en arriver à la publication de l’ouvrage de Berlin et Kay sur les termes de couleurs de base. Pour des raisons que nous tenterons d’expliciter, au relativisme initial se substitua une forme d’universalisme auquel le livre de Berlin et Kay apporta une contribution non négligeable. La seconde partie narre le développement de la théorie de Rosch au sein de ce contexte universaliste. En étendant progressivement sa théorie au-delà de ses objets initiaux (les couleurs et les formes spatiales) pour embrasser les catégories dites “sémantiques”, Rosch évolua d’une conception “analogique” ou gestaltiste de la catégorie vers une analyse en termes d’attributs discrets. Son concept de prototype incorporait initialement des traits qui venaient de la Gestalttheorie et de la notion de schéma (telle qu’elle avait été opérationnalisée en psychologie après Bartlett), pour devenir ensuite plus complexe. Tout au long de cette évolution, elle conserva une approche réaliste de la catégorie, entendue comme un agrégat “naturel” de propriétés. Pour étayer son réalisme, elle recourut à des outils théoriques forgés avant elle par Egon Brunswik (à qui elle est redevable de son index de validité de l’indice) et par Garner, à qui elle a emprunté la notion de structurelle corrélationnelle, notion issue d’une théorie informationnelle de la catégorisation. Quant à sa conception des niveaux de catégorisation, et notamment du “niveau de base”, elle doit beaucoup aux travaux de Brent Berlin sur les taxinomies populaires. Il est possible aussi que Rosch ait subi l’influence de Roger Brown, du moins en ce qui concerne les schémas d’action associés à des objets. Ithaca: Cornell University Press, 1991. Pp. xii + 377. $42.95 (cloth). This is a considerable book on a considerable topic-the logical relation of time to eternity, the possibility of a simple God's knowing temporal events, and their presence in God. The book aims to make sense of and defend the claim that God is in fact timeless, and to explore the relations between such a timeless being and temporal beings. The book is thus something of a tour de force which, as Professor Stump herself remarks in a review, no subsequent discussions of the topic will be able to neglect. It is also a mine of information about discussions of this venerable topic, ancient, medieval, and modern, with special emphasis on contemporary controversies. After plainly setting out his working assumptions, Leftow examines the possibility of the timeless and the logic of eternity. He argues that timeless entities do, or at least can, exist, whether or not God exists and is timeless. He argues further that if God exists and is timeless, " coexisting " with time does not make God temporal. Proper discourse of the eternal requires its own peculiar " eternal-present" tense. The author then turns to the classic discussions of these topics in Augustine, Boethius, and Anselm. His treatment of Boethius is mainly based on the contemporary interpretation by Eleanor Stump and Norman Kretzmann-indeed a great deal of the first half of the book consists in fencing with their view. Leftow argues that Stump and Kretzmann are correct in concluding that the Boethian concept of eternity is that of " atemporal duration," though he thinks they arrived at this conclusion for the wrong reasons. Having argued that one can understand Boethian eternity in terms of a form of duration, Leftow goes on to maintain that one can also understand it on the model of an extensionless point. At the same time, he maintains that God's life has earlier and later "positions" in a manner that this reviewer finds reminiscent of the Whiteheadian view 526 BOOK 1mvrnws of the genetic analysis of an actual occasion, or perhaps even of White· head's conception of divine everlastingness. In the long run, however, Leftow finds the Boethian view (at least as interpreted by Stump and Kretzmann) unsatisfactory. The reason is, if I have got it right, that he thinks that for Boethius as well as for Thomas Aquinas and others, God is aware of temporal things inasmuch as they are "present to God" in God's eternity. At the same time Leftow supposes (mistakenly) that for Aquinas God's knowledge is that of an observer, and he goes on to write: "Now if a temporal thing is really present to God, it seems to fallow that God and that thing exist simultaneously" (161, my emphasis). I fail to grasp how that seems to follow, unless one confuses the ontological order with the intentional, hut on the supposition that it does follow, Leftow argues that Boethius can't have it both ways: that God's knowledge, not being simultaneous with temporal events, is not foreknowledge and so does not impede human freedom, yet is truly omniscient, and so simultaneous with temporal events after all. Leftow then turns to the view of Anselm, which he judges more defensible, for he believes he finds in Anselm a position in which the temporal events that God knows are in a real sense thereby in God, and so simultaneous with God's knowledge of them. "On this alternative,... temporal events occur all at once in eternity, in addition to occurring at various points in time.... McDonough University of the South e-mail: [email protected] Basil Lanneau Gildersleeve, the eminent classicist who founded this journal, is remembered primarily as an authority on matters of grammar and philology; he was in addition something of a poet, although of limited ability, who specialized in sonnets.1 In the archives (...) of the University of the South in Sewanee, Tennessee, I recently found a number of sonnets written by Gildersleeve, all of them apparently from late in his long life.2 As these may be of interest to the readership of this journal, AJP's current editor has graciously allowed these nugae of her distinguished predecessor to be reprinted here.What follows below are seven sonnets written when Gildersleeve was evidently in or nearly in his nineties,3 all of which were copied in longhand by his niece, Mrs. Leon D. (Eleanor) Kirby, a longtime Sewanee resident.4 When and why Mrs. Kirby made these transcriptions is uncertain, [End Page 293] although her reasons appear to have been personal.5 She was not a practiced amanuensis (see below n. 14), and the text of the sonnets is largely as she copied them out, with only minor corrections.6 Because these require in places a little explication, I have supplied a brief commentary as well. From the appearance of his name fairly littering the footnotes, readers will ascertain that Professor Ward Briggs has been tremendously helpful to me in putting together this "Brief Mention."It was in one of his own late "Brief Mentions," in fact, that Gildersleeve outlined his theory that "the modern sonnet [is] an analogon on a large scale" to the elegiac distich (AJP 41.2 [1920]: 200 = Miller 1930, 402). As he continues, "The octave... represents the hexameter, the sextet, the pentameter, and the likeness to the latter is heightened by the use of terza rima."7 He ends his remarks on the matter thus: The Greeks kept prose and poetry steadily apart... but the elegiac distich was open to all; and I may claim Hellenic authority for introducing my sonnets into the company of grave grammarians. This essay is about experience, and not only about ideas. I have been drawn to write about John Cameron Mitchell’s Shortbus for a number of reasons: First, I find his work to be part of a new turn in LGBT art and media that take queer lives as a point of departure, and not only as narrative focus, for their work. These areworks that are not just about being queer, but cross the line into being queer works. Of those who (...) can be said to be a part of this recent turn, I find Mitchell’s work to be both especially philosophical and formally interesting. Not only does his work take up philosophical questions over what it means to be human, and the nature of love and sex, but also his works are produced through an organic, cooperative process that re-frames what it could mean to queer representation, political or otherwise. In an exploratory context, a qualitative approach was used to document perceptions of psychiatric advance directives among legal professionals and mental health professionals in Ontario and Quebec. A Web survey was administered and a qualitative analysis approach was used to explore attitudes towards PADs. It was found that legal and mental health professionals hold dif erent values related to clinical, ethical and legal issues, which may be related to their professional training. Among the advantages associated with PADs include their ability (...) to document a mentally ill individual’s clear wishes, respect autonomous choices and foster collaborative treatment. Reported disadvantages of PADs include the possibility of new circumstances arising, mentally ill individuals may not comprehend completing a PAD, and whether a mentally ill individual should be permitted to refuse treatment on ethical grounds. A Christian approach to the issues that constitute bioethics is inevitable for us who cherish the truth of historic, creedal, trinitarian Christianity. Scripture teaches and the Greek and Latin Church Fathers as well as the Reformers aver that man, created in the image of God, has an inherent, if vestigial, sense of right and wrong and a conscience however marred by the fall and by rebellion. We must believe that we share this most basic ecumenism with all humanity, not because (...) of rational observation and analysis of nature, but because Scripture reveals it. We who are convinced of the truth of historic, creedal, trinitarian Christianity have a high view of Scripture and hold it to be infallible and utterly trustworthy irrespective of the importance we assign to our specific post-biblical traditional distinctives. This is a narrower but much more vital ecumenism than the first. Faithful adherence to Scripture inevitably manifests itself in remarkably similar priorities and values, often, lamentably, not because of, but in spite of, ourselves. (shrink)

La doctrine du ‘contrat social’ a fait récemment une réapparition dans l'ouvrage A Theory of Justice de John Rawls. D'un avis unanime, chacun reconnaît l'importance de ce livre. Et cependant son contenu est objet de critiques divergentes. Le présent article est conçu comme une modeste contribution aux débats en cours. Après une rapide esquisse des idées maîtresses de Rawls, l'auteur dresse un bilan synoptique des conceptions du contrat social de Hobbes, Locke, Rousseau et Kant. Sont mis en évidence : 1° (...) le fait que ces quatre philosophes parlent d'un droit naturel immuable 2° le fait que, tout en étant révolutionnaires sur le plan des idées politiques, ils ne sont pas parvenus à déceler les problèmes sociaux. Rawls a intégré l'inspiration socialiste -la préoccupation de la justice sociale -dans la théorie du contrat social. Il insiste sur le dialogue impartial, base de la recherche des principes de justice politique et sociale. Son ouvrage souffre néanmoins d'une profonde incohérence. Rawls s'est tourné vers la tradition du contrat social pour sortir de l'utilitarisme, sa pensée est en effet dirigée par une inspiration toute différente. Pourtant, dans sa déduction des principes de justice, il retombe dans l'utilitarisme qu'il voulait éviter. L'ambiguïté qui en résulte le place dans l'impossibilité de répondre valablement à une critique venue de divers côtés. (shrink)
